01Acceptance of these Terms

These Contractor Terms of Use (“Terms”) govern your access to and use of the Dust Whisperers LLC (“Dust Whisperers,” “we,” “us,” or “our”) applicant and contractor platform — the online application, your account, the screening and onboarding steps, and, if you are engaged, the scheduling and communication tools we make available (together, the “Platform”). By creating an account, submitting an application, or otherwise using the Platform, you agree to be bound by these Terms. To create an account you will be asked to accept these Terms explicitly. If you do not agree, do not use the Platform. We may update these Terms from time to time; when we do, we will notify you and, where appropriate, ask you to re-acknowledge them before you continue to use the Platform.

02What this Platform is — and is not

The Platform lets you apply to work with Dust Whisperers, complete identity and background screening, review and sign onboarding documents, and — once engaged — manage your availability, receive job information, set up your payment destination and communicate with our team and the customer.

The Platform is a tool. Using it, submitting an application, or completing any step does not create an employment or independent-contractor relationship, is not an offer of work, and does not guarantee an interview, an engagement, or any particular amount of work. Any working relationship begins only if and when you sign a separate Independent Contractor Services Agreement (or, where applicable, receive and accept a written employment offer).

03Eligibility and age

You must be at least 18 years old to use the Platform. The Platform is intended for individuals applying to or engaged by Dust Whisperers as cleaning professionals. It is not for the general public and not for commercial resale.

04Your account and login security

Access to most of the Platform requires an account. You are responsible for all activity under your account and for keeping your login secure. Provide accurate account information and keep it current. Do not share your login or allow anyone else to use your account, and do not maintain more than one account. Notify us immediately at admin@dustwhisperers.com if you believe your account has been accessed without your authorization.

05Accuracy of the information you provide

You represent that the information you submit through the Platform — including your identity, contact details, address, work authorization, experience, insurance status, and any disclosures — is true, current, and complete to the best of your knowledge. Providing false or materially misleading information is grounds for declining or ending your application, withdrawing an offer, or ending an engagement.

06Background checks

A background check through a third-party screening provider is part of our hiring process. We ask you to acknowledge this when you apply, but we do not collect your authorization for the check at the application step. The legally required disclosure and your written authorization are presented to you separately, before any check is initiated, at a later step. Submitting your application does not by itself initiate a background check.

07Electronic communications and electronic signatures

By using the Platform you agree that we may communicate with you electronically, and that agreements, disclosures, and notices we provide electronically satisfy any requirement that they be in writing. You agree that your electronic signature on documents we present through the Platform — for example, the background-check authorization and the Independent Contractor Services Agreement — is legally binding to the same extent as a handwritten signature.

08Text messages, email, and internal messaging

We use email and, where you have opted in, text messages (SMS) to communicate with you about your application, interview scheduling, onboarding, and — once engaged — job assignments and updates. SMS is optional and not a condition of applying or being engaged. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts at any time, or HELP for help.

We use Slack, a third-party workplace-messaging platform, for internal coordination. Once engaged, you may be asked to use Slack and/or our mobile application for work-related communication and task updates. Only information necessary to coordinate work is shared there; payment details are never stored in Slack.

09Content you submit through the Platform

You may submit content through the Platform — for example, application answers and, once engaged, photographs documenting completed work and related notes. You grant Dust Whisperers a non-exclusive, royalty-free license to use that content to operate our business, including quality assurance, training, and recordkeeping. Do not submit content you do not have the right to share, and do not submit a customer’s personal information except as needed to perform and document work.

10Confidential customer information

Through the Platform and in the course of any work, you may learn customer names, addresses, access details, and information about their homes. This information is confidential. You agree to use it only to perform and document work for Dust Whisperers — not to retain, copy, share, or use it for any other purpose — and to follow our instructions for handling it. This obligation continues after your use of the Platform ends.

11Our intellectual property

The Platform and its content — including the Dust Whisperers name, logo, branding, written materials, checklists, cleaning processes, and software — are the property of Dust Whisperers LLC and protected by United States intellectual-property law. Using the Platform gives you no ownership of, or license to reuse, our materials or processes except as needed to perform work for us. You may not reproduce, distribute, reverse engineer, or commercially exploit any part of the Platform without our written permission.

12Prohibited conduct

When using the Platform, you agree not to:

  • share your login or access the Platform through anyone else’s account;
  • harvest, scrape, or attempt to collect the personal information of customers, other contractors, or staff;
  • misuse any access to customer homes or information you obtain through the Platform;
  • reverse engineer, copy, or replicate the Platform or our service model for commercial use without written authorization;
  • upload malicious code or attempt to disrupt, overload, or gain unauthorized access to our systems;
  • create more than one account, impersonate any person, or misrepresent your affiliation with any entity;
  • use the Platform for any purpose unlawful under federal law or the laws of the State of Texas.

Violations may result in immediate suspension or termination of your access and may be referred to the appropriate authorities.

13Suspension and termination of your account

We may suspend or terminate your access to the Platform at any time, including for violation of these Terms. Terminating your Platform account is a separate matter from any working relationship: whether and how a working relationship may be ended is governed by your Independent Contractor Services Agreement or written offer, not by these Terms.

14Relationship to other agreements

These Terms govern your use of the Platform only. They are separate from, and subordinate to, any Independent Contractor Services Agreement, employment offer, or other signed agreement between you and Dust Whisperers. If anything in these Terms conflicts with a signed agreement about the working relationship, the signed agreement controls.

15Disclaimers and limitation of liability

The Platform is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, Dust Whisperers disclaims all warranties, express or implied, regarding the Platform. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including technical errors, scheduling inaccuracies, or service interruptions. Nothing in this section limits any right you have under your Independent Contractor Services Agreement or under applicable law.

16Dispute resolution and arbitration

16.1 Scope. Except as provided in Sections 16.2 and 16.5, you and Dust Whisperers agree that any dispute, claim, or controversy arising out of or relating to your use of the Platform, your application, or the identity- and background-screening process (a “Covered Dispute”) will be resolved by binding individual arbitration rather than in court.

16.2 What this does not cover. This Section does not govern disputes arising out of an Independent Contractor Services Agreement or a written employment offer between you and Dust Whisperers; those are governed by the dispute-resolution terms of that signed agreement. Nothing here prevents either party from bringing an individual claim in small-claims court, or from seeking injunctive relief in court to protect intellectual property or confidential information.

16.3 Informal resolution first. Before starting arbitration, the initiating party will send the other written notice describing the dispute and the relief sought, and the parties will try in good faith to resolve it for at least 30 days.

16.4 Arbitration procedure. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator, seated in Dallas County, Texas. The Federal Arbitration Act governs the interpretation and enforcement of this Section, and judgment on the award may be entered in any court of competent jurisdiction.

16.5 Claims that are not arbitrable. This Section does not apply to any claim that may not be compelled to arbitration as a matter of law — including, under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, claims relating to sexual assault or sexual harassment, which you may bring in court at your election — and any other non-waivable statutory claim.

16.6 Class-action waiver. To the fullest extent permitted by law, Covered Disputes will be arbitrated only on an individual basis. You and Dust Whisperers waive any right to bring or participate in a class, collective, or representative action. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, and the rest of this Section will still apply.

16.7 Opt-out. You may opt out of this arbitration agreement by emailing admin@dustwhisperers.com within 30 days of first accepting these Terms. Opting out will not affect your application or any other part of these Terms.

16.8 Severability. If any portion of this Section (other than the class-action waiver, addressed above) is found unenforceable, that portion will be severed and the remainder will continue in effect.

17Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Except where a different forum is required by law, any dispute not subject to a valid arbitration provision shall be brought in the state or federal courts located in Dallas County, Texas.

18Changes to these Terms

We may modify these Terms from time to time. We will notify you of material changes and, where appropriate, require you to acknowledge the updated Terms before you continue to use the Platform. Continued use after notice constitutes acceptance of the revised Terms.
